By purchasing, downloading, or using DeskCharm ("the Software"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not purchase or use the Software.

License Grant
Subject to your compliance with these Terms and payment of the applicable license fee, we grant you a limited, non-exclusive, non-transferable, revocable license to:
- Download and install DeskCharm on devices you own or control
- Use the Software for personal, non-commercial purposes
- Receive updates and new charms included in your purchase
This is a one-time purchase with lifetime access to the current major version and all updates within that version.
License Restrictions
You may NOT:
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software
- Modify, adapt, translate, or create derivative works based on the Software
- Redistribute, sell, rent, lease, sublicense, or transfer the Software to third parties
- Remove, alter, or obscure any proprietary notices on the Software
- Use the Software for any illegal purpose or in violation of any laws
- Use the Software in a manner that could damage, disable, overburden, or impair our systems
Refund Policy
We offer a 14-day money-back guarantee from the date of purchase. If you are not satisfied with DeskCharm, you may request a full refund within 14 days by contacting us at vaibhavb382@gmail.com.
Refund conditions:
- Refunds are only available within 14 days of purchase
- You must provide your order ID or purchase email
- Refunds will be processed to the original payment method within 7-10 business days
- After a refund is issued, your license to use the Software is immediately terminated
- One refund per customer per product
After 14 days, all sales are final. We do not offer refunds for compatibility issues after the trial period, change of mind, or failure to read system requirements.
System Requirements
DeskCharm requires:
- macOS 14.0 (Sonoma) or later
- Apple Silicon (M1/M2/M3/M4) or Intel processor
- Approximately 10 MB of available storage
It is your responsibility to ensure your system meets these requirements before purchase. We recommend downloading the free trial (if available) to test compatibility.
Updates and Support
Your purchase includes:
- Free updates to the current major version (v1.x)
- All new charms and features released within your version
- Email support for technical issues
Future major version upgrades (e.g., v2.0) may require an additional purchase or upgrade fee. We will notify you in advance of any paid upgrades.
Disclaimer of Warranties
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Software will be uninterrupted, timely, secure, or error-free
- The Software will meet your specific requirements
- Any defects or errors will be corrected
- The Software is compatible with all hardware and software configurations
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, WHETHER ARISING FROM:
- Use or inability to use the Software
- Unauthorized access to or alteration of your data
- Software defects, errors, or malfunctions
- Any other matter relating to the Software
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE SOFTWARE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE LICENSE.
Indemnification
You agree to indemnify and hold us harmless from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:
- Your use of the Software
- Your violation of these Terms
- Your violation of any rights of another party
Intellectual Property
The Software, including all copyrights, trademarks, trade secrets, and other intellectual property rights, is and will remain our exclusive property. These Terms do not grant you any rights to our trademarks, service marks, or logos.
DeskCharm, the DeskCharm logo, and all associated graphics are trademarks of DeskCharm. You may not use these marks without our prior written consent.
Termination
These Terms are effective until terminated. We may terminate your license immediately if you fail to comply with any term of this Agreement. Upon termination:
- You must cease all use of the Software
- You must delete all copies of the Software from your devices
- Any provisions that by their nature should survive termination will remain in effect
Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of the Software shall be resolved through:

- Binding arbitration: If negotiation fails, disputes will be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996
You waive any right to participate in a class action lawsuit or class-wide arbitration.
Export Compliance
The Software may be subject to export control laws. You agree to comply with all applicable international and national laws regarding the export and use of the Software.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of the Software after changes are posted constitutes acceptance of the modified Terms.
Material changes will be communicated via email to the address associated with your purchase.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Software and supersede all prior agreements and understandings.
